Non-Molestation and Occupation Orders are available from the Family Courts and are intended to protect the holder from the abusive behaviour of a partner, ex-partner or other family member. Similar to a Restraining Order, a Non-Molestation Order would ensure that your abuser cannot contact you or continue their behaviour, including through third parties or social media such as Facebook. In some circumstance’s orders can also regulate who lives in the family home. Such orders are civil injunctions and can be made irrespective of criminal charges (or lack thereof).
It is important to understand that these types of protective injunctions are not only available to victims of physical abuse. The Courts understand that domestic abuse is not always physical. It can encompass a range of behaviours which include, but are not limited to: financial abuse, coercive control and verbally aggressive and threatening comments/ messages. All of these types of behaviours may make you feel you may feel threatened or harassed – and can have having a devastating effect on the lives of you and your children.
